COACHING IS NOT THERAPY OR PROFESSIONAL HEALTHCARE
Coaching is a collaborative personal-development process intended to support self-awareness, goal setting, decision-making, personal growth, and action.
Coaching is not psychotherapy, counseling, psychiatric care, medical treatment, diagnosis, legal advice, financial advice, or any other licensed healthcare or professional service.
Shondi Malachi does not diagnose, prevent, treat, or cure mental-health disorders, medical conditions, or other health conditions through coaching.
A coaching relationship does not create a therapist-patient, physician-patient, attorney-client, financial-advisor-client, or other licensed professional relationship.
If you believe you need medical, psychological, psychiatric, legal, financial, or other specialized professional assistance, you are responsible for consulting an appropriately qualified professional.
If you are experiencing an emergency or believe you may be in danger, contact emergency services or an appropriate crisis service in your location.
CLIENT RESPONSIBILITY
Coaching is a collaborative process.
You understand and agree that you remain responsible for your own decisions, actions, behaviors, relationships, choices, and results.
The coach may provide questions, observations, exercises, perspectives, accountability, and other coaching tools, but does not make decisions for you.
Participation in coaching does not guarantee any particular result.
NO GUARANTEE OF RESULTS
Individual experiences with coaching and personal development vary.
We make no guarantee regarding any specific personal, professional, emotional, relationship, financial, career, or other outcome resulting from coaching, programs, resources, or information provided through this website.
Results may depend on many factors, including your circumstances, participation, effort, decisions, actions, and factors outside either party's control.
Testimonials, examples, reviews, or client experiences presented on the website or social media represent individual experiences and are not guarantees that you will achieve the same or similar results.
SEPARATE COACHING AGREEMENT
Paid coaching clients may be required to review and electronically accept or sign a separate Coaching Agreement before coaching begins.
The Coaching Agreement may contain additional provisions concerning the coaching relationship, including:
-
Scope of coaching
-
Client and coach responsibilities
-
Confidentiality and its limitations
-
Scheduling
-
Communication between sessions
-
Fees and payment
-
Cancellation and rescheduling
-
Packages
-
Professional boundaries
-
Termination of the coaching relationship
If a provision in a signed Coaching Agreement specifically conflicts with these general website Terms regarding the coaching relationship, the applicable Coaching Agreement will control that issue to the extent permitted by law.
Pennsylvania law provides that a record or signature generally cannot be denied legal effect solely because it is electronic, where the Electronic Transactions Act applies and the parties have agreed to transact electronically.
CONFIDENTIALITY
We respect the privacy of information shared within the coaching relationship and will make reasonable efforts to protect client information.
However, coaching confidentiality should not be understood as equivalent to legally protected therapist-patient, physician-patient, attorney-client, or similar professional privilege.
Additional confidentiality terms and limitations may be included in the Coaching Agreement.
Information collected through the website is also subject to our Privacy Policy.
EDUCATIONAL CONTENT
Articles, videos, social-media content, downloadable materials, worksheets, exercises, emails, and other information provided by Shondi Malachi are for general educational and personal-development purposes.
They are not individualized professional advice merely because you have viewed, downloaded, or interacted with them.
Use your own judgment and seek an appropriately qualified professional when your circumstances require specialized assistance.
INTELLECTUAL PROPERTY
Unless otherwise indicated, original content available through this website—including written content, branding, graphics, videos, photographs, worksheets, frameworks, exercises, downloadable materials, courses, programs, and other original materials—is owned by or licensed to ZeHana’s Gift LLC.
Purchasing or accessing content does not transfer ownership of that intellectual property to you.
Unless we give written permission, you may not reproduce, republish, sell, distribute, commercially exploit, modify for redistribution, or represent our proprietary materials as your own.
Materials provided for personal use may be used for your own non-commercial personal-development purposes.

WEBSITE AVAILABILITY
We make reasonable efforts to maintain the website and its functionality but cannot guarantee uninterrupted or error-free access.
We may modify, suspend, update, or discontinue website content, services, features, or offerings when reasonably necessary.
APPROPRIATE USE AND CONDUCT
You agree not to use this website or our services for unlawful, fraudulent, abusive, threatening, harassing, or otherwise inappropriate purposes.
We reserve the right to restrict access or discontinue a coaching relationship when necessary because of harassment, threats, fraudulent conduct, repeated boundary violations, nonpayment, misuse of services, or circumstances that make continuation inappropriate.

By purchasing a service, you represent that you have the legal capacity to enter into the transaction.
LIMITATION OF RESPONSIBILITY
You acknowledge that personal-development decisions ultimately remain your responsibility.
To the extent permitted by applicable law, we are not responsible for losses resulting solely from decisions or actions you independently choose to take based upon general educational information or participation in coaching.
Nothing in these Terms is intended to exclude or limit liability or consumer rights where doing so would be prohibited by applicable law.
ACCURACY OF REPRESENTATIONS
We strive to accurately describe our services, qualifications, offerings, prices, and professional status.
Nothing on this website should be interpreted as representing that Shondi Malachi holds a professional license, credential, certification, endorsement, or affiliation unless that qualification is expressly and accurately identified.
Pennsylvania's consumer-protection law addresses misleading representations concerning the source, sponsorship, approval, certification, affiliation, characteristics, and benefits of services.
TERMINATION OF COACHING SERVICES
Either the client or coach may determine that the coaching relationship should end.
We may discontinue coaching when, for example:
-
A client's needs appear to fall outside the scope of coaching;
-
Continued coaching would not be appropriate;
-
Payment obligations are not fulfilled;
-
Professional boundaries are repeatedly violated; or
-
The coach or client determines that the relationship is no longer an appropriate fit.
